BREAKING: Court Dismisses Mohbad’s Father’s Case Against Naira Marley, Sam Larry

An Ikeja High Court has dismissed a suit filed by Mr. Joseph Aloba, the father of the late singer Ilerioluwa Aloba, popularly known as Mohbad, challenging the legal advice that cleared music executive Azeez Fashola (aka Naira Marley) and show promoter Samson Balogun (aka Sam Larry) of involvement in his son’s death.
The suit, brought by Aloba through his lead counsel Dr. Wahab Shittu (SAN), named the Lagos State Attorney General and the Director of Public Prosecutions (DPP) as respondents.
In her ruling on Wednesday, Justice Taiwo Olatokun held that the Attorney General’s prosecutorial powers were absolute and not subject to judicial review, effectively dismissing Aloba’s application.
Shittu had argued that the DPP’s legal advice denied the family fair hearing and was premature, as it exonerated Marley and Larry before the coroner’s inquest into Mohbad’s death had concluded. He further claimed that key suspects named during the inquest were let go prematurely.
However, the respondents maintained in their counter-affidavit that the suspects were not acquitted but only discharged, and emphasized that the legal advice did not obstruct the coroner’s proceedings. They also noted that there was no directive from the coroner requiring the DPP to inform the inquest of its conclusions.
The court ultimately sided with the respondents and struck out the application.
